Epic Games Challenges Apple's New App Store Regulations in EU

The recent changes to Apple's App Store regulations have received mixed reactions, particularly from Epic Games, the company behind Fortnite. While the European Commission has expressed satisfaction with Apple's adjustments, Epic believes these modifications still infringe upon the Digital Markets Act (DMA).

European Commission's Perspective

A spokesperson from the European Commission stated that they welcome Apple's new business terms. This follows a series of discussions between the Commission and Apple, particularly after a non-compliance decision made in April 2025 regarding Apple’s steering terms and alternative app distribution. The spokesperson highlighted the removal of the Core Technology Fee as a positive step, although they did not address the introduction of a new 5% Core Technology Commission.

Epic Games' Response

Epic Games took to X to express their concerns, stating that Apple's terms contradict the DMA’s requirements. They emphasized that developers should be able to link out to web purchases without incurring extra charges and that effective competition from alternative app stores should be facilitated. Epic warned that if the Commission accepts Apple's current terms, it risks undermining the DMA's intended benefits for consumers and developers.

Impact on Third-Party App Stores

Recently, Epic launched a version of the Epic Game Store for iOS, which is now accessible in regions where Apple's compliance is legally mandated, including the EU, Japan, and Brazil. However, the company is critical of Apple's commission fees, which range from 10% to 15% on transactions made through linked web pages, and they are equally discontent with the new 5% fee for third-party app stores.

Broader Implications in the Tech Industry

This situation is not isolated to Apple; Epic Games has also taken legal action against Google, leading to changes in Play Store fees and the process for installing third-party app stores on Android devices. While an Epic Games Store for Android exists, it is currently only available via web download, with plans for broader availability in the future.

As the debate over app store regulations continues, the outcomes of these discussions will likely have significant implications for developers and consumers alike.
